PRIVACY NOTICE

Rams FinTech Sdn. Bhd. (“we”, “us”, “our”), a subsidiary of Ramssol Group Berhad and operator of the Pay Day Now application and website (the “Platform”), is committed to protecting your personal data in compliance with the Personal Data Protection Act 2010 (“PDPA”), its subsidiary legislation, and other applicable Malaysian laws.

By accessing or using the Platform, you accept this Privacy Policy, which is deemed incorporated into our Terms of Use.

1. DEFINITIONS

  1. “Personal Data” means any data that relates directly or indirectly to an individual who is identified or identifiable, as defined under PDPA.
  2. “Sensitive Personal Data” includes data such as medical records, biometric data, etc., requiring specific consent under section 37 of the PDPA.
  3. “Data Subject”, “Data User”, “Processing”, and other terms carry the meanings prescribed in the PDPA.

2. SCOPE AND CONSENT

This Privacy Policy applies to all Personal Data collected (directly or via your employer) for your use of the Platform.

By using the Platform, you explicitly consent to our processing of your Personal Data for the purposes listed herein, as permitted under PDPA.

3. PERSONAL DATA COLLECTED

In the course of your interaction with the Pay Day Now Platform—whether through account registration, salary advance requests, employer integrations, or customer support—we may collect and process the following categories of Personal Data. This data may be obtained directly from you, through your employer (with your consent), or automatically through your use of our Platform. We may collect:

  1. Identification & Contact Data: name, NRIC, passport, date of birth, gender, nationality, residential address, email, mobile number.
  2. Employment & Financial Data: employer name, job title, salary, employee ID, bank account details, payslips, EPF/SOCSO.
  3. Technical & Usage Data: IP address, device identifiers, browser data, login timestamps, location data (where enabled), cookies
  4. Transaction Data: salary advance requests, withdrawal history, promotional fees and campaign usage

4. PURPOSE OF PROCESSING

Your personal data is collected and processed by Rams FinTech Sdn. Bhd., in its capacity as the data user, for one or more of the following lawful purposes, in accordance with Sections 6 and 7 of the Personal Data Protection Act 2010:

  2. Salary advance eligibility assessment
  3. Transaction facilitation and reconciliation
  4. Notifying you about salary deduction schedules
  5. Communications via email, SMS, or in app alerts
  6. Reporting to your employer for salary deduction (with consent)
  7. Legal and regulatory compliance (e.g., PDPA, Employment Act, AML/CFT regulations
  8. Audit, analytics, Platform maintenance, and support
  9. Marketing (subject to your prior consent)

5. DISCLOSURE OF PERSONAL DATA

We may disclose or share your Personal Data with third parties in the manner and for the purposes set out below. All disclosures are subject to the principles and requirements under the Personal Data Protection Act 2010, including the duty to ensure that any recipient upholds equivalent data protection standards.

5.1. Disclosure to Your Employer

We may disclose your relevant personal and transactional data to your employer for the following purposes:

  1. Verifying your employment status and income eligibility;
  2. Facilitating salary deductions as authorised by you in accordance with Section 24 of the Employment Act 1955;
  3. Issuing deduction reports and notifications of withdrawal requests;
  4. Confirming settlement or repayment schedules and handling related payroll adjustments.

Such disclosure shall be limited to what is necessary and shall occur only where your explicit consent has been obtained in accordance with PDPA.

5.2. Disclosure to Third-Party Service Providers

We may engage with selected third-party service providers to support and enhance our operations. These include:

  1. Payment processors and remittance gateways;
  2. Cloud hosting and data infrastructure partners;
  3. Cybersecurity and system monitoring firms;
  4. Analytics and behavioural insights vendors;
  5. Customer support service providers (e.g., call centres, chatbots).

All service providers are contractually bound by strict data protection and confidentiality obligations that are PDPA-compliant. They are only permitted to use your data for the purpose of providing services on our behalf and not for their own independent use.

5.3. Disclosure to Regulatory Authorities and Law Enforcement

We may disclose your Personal Data to regulatory bodies, law enforcement agencies, or other government authorities if:

  1. Required to do so under applicable laws, court orders, or governmental regulations (e.g., AMLA, PDPA, Employment Act);
  2. Necessary for compliance with licensing conditions or statutory obligations;
  3. Requested as part of an audit, investigation, or enforcement action involving fraud, financial crime, or misconduct.

In such cases, we will limit the disclosure to what is legally necessary and, where feasible, will notify you unless restricted by law.

5.4 Disclosure in Corporate Transactions

In t.he event of a corporate exercise involving Pay Day Now or its holding company, such as a merger, acquisition, asset disposal, restructuring, joint venture, or transfer of business operations:

  1. Your Personal Data may be disclosed to prospective or actual acquirers, investors, advisers, or other parties to the transaction;
  2. Any such disclosure will be subject to confidentiality undertakings, and your data will continue to be processed only for legitimate business purposes;
  3. In the event of a completed transaction, all successors or assigns will be required to comply with this Privacy Policy or provide a policy offering equivalent protection.

5.5. Restriction on Unauthorised Disclosure

We affirm that:

  1. We do not sell, lease, trade, or rent your Personal Data to any unrelated third parties for direct marketing or other commercial purposes;
  2. Any disclosure that falls outside the scope of the above will require your explicit written consent, in line with PDPA.

6. CROSS-BORDER TRANSFER

We may transfer your Personal Data outside Malaysia under the following conditions:

  1. Your explicit consent;
  2. Necessary to fulfill a contract;
  3. Transfer occurs under adequate protections consistent with PDPA

Currently, no countries have been gazetted as providing “substantially similar” protection.

7. DATA RETENTION

We implement industry-standard safeguards including encryption (in transit and at rest), access controls, firewalls, and intrusion detection, in line with Malaysian fintech practices . Nevertheless, as no system is entirely infallible, certain risks remain beyond our control.

9. YOUR RIGHTS

You, as a Data Subject, have the rights under PDPA to:

  1. Request access to, and copies of, your Personal Data
  2. Request correction or update of inaccurate or incomplete data
  3. Withdraw consent (subject to limitations such as legal retention)
  4. Request cessation of processing or deletion of data (subject to legal obligations)
  5. Lodge complaints with our DPO or the PDPC
  6. Submit these via contacting our Data Protection Officer.

Our Platform uses cookies, web beacons, and analytic tools to enhance performance, security, and user experience. You may configure your browser or device to refuse or delete cookies, though this may degrade Platform functionality.
